Seller Side

• The Seller is the Registered/Legal owner and/or has valid authorization from the Registered owner of the Vehicle, the details of which have been mentioned in Registration Certificate provided by the Seller and is legally competent to sell the Vehicle. In case of Authorized Representative, the Authorized Representative represents that he/she is fully authorised and competent to act for and on behalf of the Registered owner for sale of the Vehicle including entering into this transaction agreement and hereby indemnifies Buyer in case of any contest/falsity to the said extent, if identified or comes to the knowledge of Buyer or CARS24 even at a later stage.
• That as on date there are no violations under applicable laws including but not limited to any accident involving the Vehicle. The Seller acknowledges and indemnifies the Buyer for any pending violations or offences, traffic, prior damage due to any accident or natural calamities or otherwise involving the Vehicle. Seller acknowledges that any misrepresented facts about the Vehicle or its condition shall make the Seller solely liable to compensate the Buyer for the same. In case Buyer has to incur any cost(s)/loss(es) for any of the before-mentioned representations in this para then the consequence and expenses shall be borne by the Seller and the Buyer shall not be liable for the same in any nature whatsoever.
• That the Vehicle is free from any kind of encumbrances including but not limited to any liability such as superdari, theft, arrears of sales tax, value added tax, road tax, government dues, blacklisted in government records, or similar liabilities as on date. In case any such encumbrances and/or liabilities are identified or come to the knowledge of the Buyer then the same shall be borne by the Seller. The Seller also understands that if any discrepancies are identified and/or found in the ownership of the Vehicle then all related cost(s)/expenses to rectify the same shall be borne solely by the Seller.
• If there is any challan, encumbrance on car, Sellers acknowledges that CARS24 will hold back amount to ensure compliance by seller.If the encumbrance not resolved in 7 days, CARS24 will right to forfeit the amount
• That there are no loans including but not limited to any linked loan, and in case any such loan is identified or comes to the knowledge of the Buyer thereby restricting any transfer of the ownership of the Vehicle, then any amount of such loan shall be adjusted by the Buyer against the Full and Final price of the Vehicle. In case of any such amount arises subsequent to the receipt of full amount by the Seller then the Buyer shall possess all rights to claim the same along with incidental expenses from the Seller and the Seller shall be liable to pay the same in favour of the Buyer on a simple demand notice.
• That the vehicle’s odometer is not tampered and the vehicle is not blacklisted/stolen. The seller also represents that he/she has not held back any material information (that can impact pricing or buyer’s consideration to buy the car) related to the vehicle under sale consideration. If it is found that the seller has held back any information, the seller would have to take the vehicle back from buyer (post sale transaction) and refund the entire amount to the buyer
• Seller agrees that he would make the vehicle available for Re-Inspection at the time of final transaction. If there is a change in the condition of the vehicle from the time of first inspection (at the time of listing of the vehicle with CARS24), then the Seller acknowledges that CARS24 will suggest price adjustment to both the Buyer and the Seller. Post that, Buyer and Seller may decide to go ahead / cancel the sale transaction as per their mutual understanding.
• Seller agrees that final transaction between Seller and Buyer happens in front of CARS24, otherwise CARS24 will not entertain any payment / vehicle disputes later on
• Seller warrants that if he sells the car during the interim period of 21 days to a buyer, not introduced by CARS24, he will promptly inform CARS24.
• Seller warrants that he will not sell the car to a buyer, introduced by CARS24, without informing CARS24
• If he does that, he will liable to pay the commission payable by the buyer
• Seller agrees to meet buyers as per mutually agreed date and time
• Car is seller’s responsibility even including during test drives. Seller agrees to make car available for test ride / inspection of car by CARS24 and buyer
• Any risk of damage during test ride has to be borne by seller and settled directly between buyer and seller.
• Seller agrees to Re Inspection at time of final transaction
• If change in condition, then CARS24 to suggest price adjustment to both buyer and seller
• The Seller understands and agrees that he/she shall cooperate for all requisite formalities for the smooth transfer of ownership of the Vehicle which may include visiting concerned RTO, if required and mandated
• Seller agrees to pay CARS24 service charges for using its services
• When handing over the car, everything that was in the inspection report and in the test ride of the buyer, should be there
• Seller can request for de-listing by expressly contacting CARS24 (email / call)
• Seller allows us to list his car on our website
• Seller allows us to display his phone number, address, etc on our website
• Seller allows us to call / correspond with him
• Seller allows us to share his contact info with interested buyers
• CARS24 decision to offer B or C is at our discretion and will not be explained to the seller and can be changed
• CARS24 may allow the seller to move from B offer to C offer at its discretion
• CARS24 will hold and protect the RC/ other proof to enable the transaction but does not warrant that RC cannot be lost / damaged.
• If lost or damaged, CARS24 will compensate upto Rs 5,000 one time to the consumer
• Company will keep the car alive on the website / platform for upto 21 days or car being sold, whichever is earlier
• After 21 days, minimum guarantee does not apply
• Company does not guarantee that it will be able to find a willing buyer at the predetermined price and within defined timeframe
• Company’s determination of the price range is based on its proprietary database and algorithm and reflects current market price based on demand and supply to the best of company’s abilities. Company reserves the right to change the value.
• Minimum guarantee of CARS24 is also subject to reinspection and can be revised if any change in condition
